Onspecial Terms and Conditions

Welcome to Onspecial, a mobile and web-based platform operated in South Africa. These Terms and Conditions ("Terms") govern your use of the Onspecial platform (the "Platform"), which includes our mobile app, website, and all related services.

By accessing or using the Platform, you agree to be bound by these Terms. Please read them carefully.


1. Overview of Our Service

Onspecial connects users with verified stores, food outlets, and retailers offering discounted or promotional items (“specials”). The Platform allows you to:

  • Browse and purchase eligible products or meals;

  • Arrange delivery to a selected address;

  • Track orders and receive notifications.

Onspecial facilitates transactions between users and independent third-party sellers (“Retailers”). We do not produce or directly sell any items listed on the Platform.


2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old;

  • Be legally capable of entering into binding agreements under South African law.

By registering, you confirm that the information provided is accurate and complete.


3. Account Registration

Creating an account is required to access some features. You are responsible for keeping your login details secure and for all activities that occur under your account.

We may suspend or terminate accounts due to suspected fraud, misuse, or policy violations.


4. Orders and Transactions

  • Orders are confirmed after successful payment.

  • Availability of products is subject to stock and acceptance by the Retailer.

  • Prices include VAT and may change without prior notice.

  • Promotions are valid for the advertised period or while stocks last.

  • By placing an order, you accept the total cost, including applicable delivery or service fees.

  • Orders may be canceled or limited at our discretion. Full refunds will be issued for canceled transactions.


5. Deliveries

  • Deliveries are fulfilled by Onspecial or approved delivery partners.

  • Delivery times are estimates and may vary.

  • Availability depends on your location and the nature of the order.

  • It is your responsibility to ensure someone is available to receive the delivery. Missed deliveries may result in extra charges.

  • Perishable items are non-refundable after an unsuccessful delivery attempt.


6. Returns and Refunds

Under the Consumer Protection Act (68 of 2008):

  • Non-perishable defective goods may be returned within 6 months of delivery for a refund, repair, or replacement.

  • Perishable items (such as food) may only be returned if spoiled, unsafe, or significantly different from what was advertised.

  • Refund requests must be made within 48 hours of receiving a food delivery, and must include relevant evidence (e.g., photos).

  • Refunds will be issued to the original payment method, subject to inspection and approval.


7. Retailer Responsibility

Retailers are solely responsible for:

  • Preparing, packaging, and ensuring product quality and safety;

  • Accurate product descriptions, prices, and availability;

  • Compliance with all applicable food safety and consumer laws.

Onspecial does not guarantee allergen-free products. Please contact the Retailer directly for allergen or ingredient-related queries.


8. User Conduct

You agree not to:

  • Use the Platform for illegal activities;

  • Provide false or misleading information;

  • Interfere with the Platform’s operation or security;

  • Attempt to scrape, replicate, or exploit the Platform for commercial purposes.

Accounts may be suspended or permanently banned for violating these terms.


9. Intellectual Property

All Platform content, including trademarks, logos, and software, is owned or licensed by Onspecial. Unauthorized reproduction or distribution is prohibited without written permission.


10. Privacy and Data Protection

We process your personal data in line with the Protection of Personal Information Act (POPIA), 2013.

Your data is used to:

  • Manage your account and orders;

  • Process payments and facilitate deliveries;

  • Send service updates or marketing (if you opt in).

We use standard security practices to protect your data. See our Privacy Policy on the Platform for more details.


11. Limitation of Liability

To the extent allowed by law, Onspecial is not liable for:

  • Losses from using or being unable to use the Platform;

  • Delivery delays, incorrect items, or defective goods;

  • Harm caused by Retailers, delivery services, or third-party providers.

Our liability is limited to the value of the order in question.


12. Updates to Terms

We may update these Terms periodically. The latest version will be posted on the Platform. Continued use after changes indicates your acceptance of the revised Terms.


13. Governing Law

These Terms are governed by the laws of South Africa. Any legal disputes may be submitted to a South African court or the Consumer Goods and Services Ombud (CGSO).


14. Entire Agreement

These Terms, along with our Privacy Policy, form the complete agreement between you and Onspecial regarding use of the Platform.
